Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the website streamorbit.io and the cloud-based 24/7 live streaming service provided by StreamOrbit (“StreamOrbit”, “we”, “us”). By creating an account or using the Service you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility & account

  • You must be at least 16 years old to use the Service.
  • You must provide accurate information when registering and keep it up to date.
  • You are responsible for the security of your account credentials and for all activity that happens through your account.
  • You must notify us immediately at hi@streamorbit.io if you suspect unauthorised access.
  • One account per person or legal entity unless we agree otherwise in writing.

3. The Service

StreamOrbit lets you upload pre-recorded videos and broadcast them on a loop or a schedule to third-party destinations such as YouTube Live, by entering the destination’s RTMP stream key. Features, limits and supported destinations may change as we improve the product.

4. Pay-as-you-go billing

4.1 Wallet

The Service is billed from a prepaid wallet. You add credit (“top-up”) through our payment provider (Polar). The minimum top-up is $5 and the maximum per transaction is $500.

4.2 Charges

While a broadcast is running we deduct credit from your wallet second-by-second at the per-hour rate published on the pricing page at the moment the stream started. When your wallet reaches zero, or when an active budget cap is reached, the stream stops automatically.

4.3 Price changes

We may change per-hour streaming rates at any time. Changes take effect for new broadcasts started after the change. Top-up minimums and maximums may also change.

4.4 Refunds

Wallet credit is non-refundable except where required by applicable consumer law or where we determine, at our sole discretion, that a refund is warranted (for example a clear duplicate charge or a confirmed service-side outage). Credit that has already been spent on streaming is non-refundable.

4.5 Taxes

Prices shown are exclusive of any applicable VAT or sales tax, which will be added at checkout where required.

5. Your content

You retain all ownership of the videos, thumbnails, titles, playlists and other materials you upload (“Your Content”). You grant StreamOrbit a worldwide, non-exclusive, royalty-free licence to store, process, transcode and transmit Your Content solely for the purpose of operating the Service for you (for example: storing it on object storage, generating thumbnails, and pushing it to the streaming destinations you configure).

You represent and warrant that you own Your Content or have all necessary rights, licences and permissions to upload it and to broadcast it to the destinations you configure.

6. Acceptable use

You may not use the Service to upload, store, broadcast or distribute content that:

  • infringes any third party’s intellectual-property, publicity or privacy rights;
  • is illegal, defamatory, obscene, sexually explicit involving minors, or promotes self-harm, violence or terrorism;
  • contains malware, exploits or attempts to gain unauthorised access to any system;
  • violates the terms of the destination platform (e.g. YouTube’s Community Guidelines or Terms of Service);
  • is used to mislead, harass, dox or impersonate any person or organisation.

You also agree not to:

  • resell, sublicense or expose the Service to third parties without our written agreement;
  • attempt to reverse-engineer, scrape or overload the Service;
  • circumvent billing, rate limits, quotas or budget caps;
  • use the Service to send spam or to broadcast 24/7 black/blank streams that exist only to game third-party platforms.

7. Third-party destinations

When you broadcast to a destination such as YouTube Live, that destination’s own terms, community rules and copyright policies apply to your stream. We are not responsible for actions taken by those destinations (including takedowns, strikes or account suspensions). You are responsible for keeping your destination accounts in good standing.

8. Stream keys & credentials

Stream keys you enter are stored encrypted at rest and are only decrypted in memory by our streaming engine when a broadcast starts. You are responsible for rotating your stream keys if you believe they have been compromised.

9. Service availability

We work hard to keep the Service reliable but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, upgrades, security incidents or for reasons beyond our reasonable control (force majeure, third-party outages, network issues, destination-platform problems).

10. Suspension & termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have breached these Terms, used the Service unlawfully, exposed us or other users to risk, or repeatedly received complaints from rights holders or destination platforms.

You may delete your account at any time from the dashboard. On termination we stop running your broadcasts and delete or anonymise your data as described in the Privacy Policy. Wallet credit remaining at the time of termination by you is forfeited unless a refund is required by law.

11. Intellectual property

The Service, including the StreamOrbit name, logo, website, software, documentation and design, is owned by StreamOrbit and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.

12. DMCA / copyright complaints

If you believe content broadcast through the Service infringes your copyright, send a notice to hi@streamorbit.io with: (a) your contact details; (b) identification of the work claimed to be infringed; (c) the location of the allegedly infringing content; (d) a statement of good-faith belief and accuracy under penalty of perjury; and (e) your signature (electronic is fine). We may remove the content and, where appropriate, suspend repeat infringers.

13. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation, to the maximum extent permitted by law.

14. Limitation of liability

To the maximum extent permitted by law, StreamOrbit will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profit, revenue, data, goodwill, channel monetisation, viewership or subscribers, arising out of or related to your use of the Service.

Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to StreamOrbit in the three (3) months preceding the event giving rise to the claim, or (b) USD 50.

15. Indemnity

You agree to defend, indemnify and hold harmless StreamOrbit from any claim, demand, loss or expense (including reasonable legal fees) arising out of (a) Your Content; (b) your breach of these Terms; or (c) your violation of any law or any third-party rights, including a destination platform’s terms.

16. Changes to the Terms

We may update these Terms from time to time. If we make material changes we will notify you by email or via a notice in the dashboard. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Governing law & disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought before the competent courts of İstanbul, Türkiye, except where mandatory consumer-protection law grants you the right to bring proceedings in your country of residence.

18. Miscellaneous

  • If any provision of these Terms is held unenforceable, the rest will remain in effect.
  • Our failure to enforce a provision is not a waiver of our right to do so later.
  • You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition or sale of assets.
  • These Terms, together with the Privacy Policy, are the entire agreement between you and StreamOrbit regarding the Service.
